1.1. The Operator’s Policy on Personal Data Processing (hereinafter referred to as the Policy) is developed to ensure the protection of the rights and freedoms of the personal data subject during the processing of their personal data, including the protection of privacy rights, personal and family secrets.
1.2 The main concepts used in the Policy:
1.2.1. Personal data — any information related to a directly or indirectly identified or identifiable individual (personal data subject);
1.2.2. Personal data processing — any action (operation) or set of actions (operations) with personal data, performed with or without the use of automation tools. Personal data processing includes, among other things:
- collection;
- recording;
- systematization;
- accumulation;
- storage;
- clarification (updating, modification);
- extraction;
- use;
- transfer (distribution, provision, access);
- anonymization;
- blocking;
- deletion;
- destruction.
1.2.3. Automated processing of personal data — processing of personal data using computer technology;
1.2.4. Distribution of personal data — actions aimed at disclosing personal data to an undefined number of persons;
1.2.5. Provision of personal data — actions aimed at disclosing personal data to a specific person or a specific circle of persons;
1.2.6. Blocking of personal data — temporary cessation of personal data processing (except in cases where processing is necessary to clarify personal data);
1.2.7. Destruction of personal data — actions resulting in the impossibility to restore the content of personal data in the personal data information system and (or) resulting in the destruction of tangible personal data carriers;
1.2.8. Anonymization of personal data — actions resulting in the impossibility to determine the belonging of personal data to a specific personal data subject without the use of additional information;
1.2.9. Personal data operator (operator) — a state body, municipal body, legal or natural person, independently or jointly with others organizing and (or) carrying out the processing of personal data, as well as determining the purposes of personal data processing, the composition of personal data to be processed, actions (operations) performed with personal data.
1.3. The operator who has access to personal data is obliged to maintain the confidentiality of personal data — not to disclose personal data to third parties and not to distribute personal data without the consent of the personal data subject, unless otherwise provided by law.
1.4. The personal data subject has the right to receive information related to the processing of their personal data, including:
- confirmation of the fact of personal data processing by the operator;
- legal grounds and purposes for personal data processing;
- purposes and methods used by the operator for personal data processing;
- the name and location of the operator, information about persons (except for employees of the operator) who have access to personal data or to whom personal data may be disclosed under a contract with the operator or by law;
- processed personal data related to the respective personal data subject, the source of their receipt, unless another procedure for providing such data is provided by law;
- the processing period of personal data, including the storage period;
- the procedure for exercising the rights of the personal data subject provided by law;
- information about the performed or intended cross-border data transfer;
- the name or surname, first name, and address of the person processing personal data on behalf of the operator, if the processing is assigned or will be assigned to such a person;
- other information provided by the law "On Personal Data" or other laws.
1.5. The personal data subject has the right to demand the operator to clarify their personal data, block or destroy them if the personal data are incomplete, outdated, inaccurate, illegally obtained, or not necessary for the declared purpose of processing, and to take measures provided by law to protect their rights.
1.6. The personal data subject has the right to protect their rights and legitimate interests, including compensation for damages and (or) moral harm in court.
1.7. The personal data operator has the right to:
— defend their interests in court;
— provide personal data of subjects to third parties if provided by applicable law (tax authorities, law enforcement agencies, etc.);
— refuse to provide personal data in cases provided by law;
— use the personal data of the subject without their consent in cases provided by law.
